Driving on public streets is a privilege, not a right and there are lots of reasons, besides the obvious ones we all know, for which your driver´s license may be suspended or revoked and can lead to an arrest. Let´s start by defining the meaning of these two terms, their consequences depending on the state, and what they imply for your driving records:
SUSPENSION
A temporary hold for any qualifying violation that deems you to drive for a period of time. Definite Suspension: a set period of time in which your license will be invalid and depends on the type of violation. Indefinite Suspension: this means that your license will remain invalid until you take the necessary corrective actions.
REASONS FOR SUSPENSION:
- Committing an offense in another state
- Possession, display, or attempted fraudulent use of a license, permit or identification card issued to another
- Driving without a license
- Driving on an invalid license
- Violation of license classification (like driving a bus without a bus license)
- Fleeing or attempting to elude the police
- Leaving the scene of a property damage accident involving more than $1,000.00 in damages
- Illegal operation of a motor vehicle resulting in death or injury requiring immediate medical treatment
- Two violations of possession or transportation of alcohol in a motor vehicle
- Refusing to submit to chemical testing after a DUI arrest
- Submission to chemical testing which reveals a blood alcohol content of .08 or greater or any amount of drug substance or compound resulting from the unlawful consumption of cannabis or a controlled substance
- The alteration, fictional or fraudulent use of handicapped license plates or parking placards
- Three moving violations within a 12-month period (if you are 21 years of age or older) which result in a total number of points under the level that requires revocation rather than suspension
- Failure to answer a traffic/court summons
- Not carrying auto insurance coverage
- Failing to report an accident
- Passing a school bus while loading/unloading
CONSEQUENCES OF SUSPENSION:
The state will impose a fine, you will have to pay a reinstatement fee and fulfill other terms outlined by the court or the Department of motor vehicles.
REVOCATION:
Losing the privilege of driving for certain driving offenses.
REASONS FOR REVOCATION:
- Manslaughter
- Negligent homicide
- Committing a felony involving the use of a motor vehicle
- Use of altered or fictitious license plates
- Altering a disability license plate or parking decal
- Operating under the influence of alcohol or drugs
- Failure to stop and give identification at the scene of an accident.
- Reckless driving
- Reckless homicide
- Unlawful blood-alcohol content (BAC) level
- Refusing to take a chemical test
- Impaired driving
- Any blood-alcohol level in a driver under 21 years of age
- Refusing to take a breathalyzer test by a driver under 21 years old
- Driving over the legal speed limit
- Failing to yield to an emergency vehicle
- Careless driving
- Disobeying a traffic signal
- Disobeying a stop sign
- Improper passing
- Failing to stop at a railroad crossing
- Failing to stop for a school bus
- Disobeying a school crossing guard
- Too many traffic ticket-points
- Driving with a suspended license
- Driving under the influence
- Suspended, canceled, or subject to disqualification
- Leaving the scene of an accident involving injury or death (hit and run)
- Drag racing/street racing
- Three or more convictions for moving violations (two or more if you are under 21)
- Aggravated fleeing and eluding the police
- Operating a commercial motor vehicle when your driving privileges are revoked, suspended, canceled, or subject to disqualification.
- Three offenses of reckless driving within 12 months
CONSEQUENCES OF REVOCATION:
It lasts for a minimum of one year or more, depending on the offense and the record of the previous violation. You will need to appear for a hearing. A revoked license cannot be reinstated, it requires going through the process of applying for a new one, and in some cases, the state may deny your application. A driver´s license revocation will also affect your ability to get car insurance.
NON-DRIVING RELATED VIOLATIONS:
Some states have a list of curious nondriving violations that can cause the suspension of a driver´s license:
- Failure to pay child support
- Underage possession, consumption, or purchase of tobacco
- Failing to pay your federal student loans
- Skipping school with unexcused absences for more than 15 days within a 90-day period
- Writing bad checks on purpose
- Operating a boat while drunk
- Failing to pay debts to the state
- Vandalism and drawing graffiti on public buildings
- Advocating the overthrow of the government
- Operating an amusement ride while intoxicated
- Parental right to withdraw minor children’s permission to obtain a driver´s license
